Mobity LLC, a California Limited Liability Company and our subsidiaries and other controlled affiliates (“Mobity”, “we”, “our”, or “us”) respect your online privacy. We put great efforts to see that the personal information we may collect from you is processed and used safely and properly, and that our data practices are effectively communicated to our website visitors.

This Privacy Policy describes how we collect, store, use, and disclose “Mobity Website Visitor Data”.

Mobity Website Visitor Data is the personal information we collect from the visitors of www.mobity.com and any other sites owned or operated by us (“Websites”).  However, any personal information or prospect data we may collect in person, by mail, by phone, through any advertising (which may link to or can be accessed from our Websites), or by any other means is beyond the definition or scope of Mobity Website Visitor Data. Please note, this Privacy Policy applies only to the Mobity Website Visitor Data.

However, if you are a Mobity Client or Partner or Prospect, and if we have provided you with a separate privacy notice on how we use your Personal Information, then that policy will also apply to your personal information.

You are not legally required to provide us with any personal information and may do so (or avoid doing so) at your own free will. If you do not wish to provide us with your personal information, or to have it processed by us or any of our Service Providers (defined below), please avoid any interaction with us and do not use our websites.

We collect and generate, for our own purposes, the following types of personal information concerning visitors to our websites (“Mobity Website Visitor Data”): Usage information collected from visitors to our websites (connectivity, technical and aggregated usage data, such as user agent, internet domain and host names, IP addresses, device data (like type, OS, device id, browser version, locale and language settings used), activity logs, session recordings, the cookies and pixels installed or utilized on their device and the website you linked from to our Websites. We collect such data either automatically, through the data subject’s interaction with us, or with our Websites or services; or through third-party services, social media, analytics tools, events we organize or participate in, and other business initiatives.

We also collect the information you voluntarily provide to us if you contact us through our Website forms. In addition, we also collect any relevant information you share with us during our marketing, sales, or service delivery interactions. Such interactions may include but are not limited to our physical or online meetings, event and conference interactions, phone calls, emails, other digital or non-digital correspondences, and any analyses thereof. The personal information you provide may include but is not limited to your name, title, company name, address, phone and fax numbers, email address, company type, company description, company URL, and the nature of your or your company’s interests.

In addition, we may also have certain legal and regulatory responsibilities to verify the identity of our customers and may need to make certain inquiries and obtain certain information from you to do so. You confirm that all information you supply will be accurate and that we may disclose such information as we consider necessary to comply with any reporting or legal and regulatory requirements.

We process and use Customer Data in accordance with the reasonable instructions of our customer. To the extent that the California Consumer Privacy Act (“CCPA”) applies, our customer will be deemed the “business” (under the CCPA) with respect to Customer Data; and Mobity will be deemed the “service provider” when processing such data.

We process and use Mobity Website & Prospect Data for the following general purposes: 

  • As necessary for the performance of our services
  • To comply with our legal and contractual obligations
  • To support our legitimate interests in maintaining and improving our services, e.g. in understanding how our services are used, how our campaigns are performing, and gaining insights which help us dedicate our resources and efforts more efficiently
  • In marketing, advertising, and selling our services
  • In providing customer service and technical support and
  • In protecting and securing our customers, users, visitors, prospects, ourselves, and our services.

Specifically, we use Mobity Website & Prospect Data for the following purposes: 

  • To facilitate, operate, and provide our services
  • To improve our data analytics models
  • To train our customer and user-facing staff
  • To authenticate the identity of our users and to allow them access to our Websites and services
  • To provide our customers and users with assistance and support
  • To gain a better understanding on how individuals use and interact with our Websites and services, and how we could improve their and others’ user experience
  • To continue improving our products, offerings, and the overall performance of our services;
  • To facilitate and optimize our marketing campaigns, ad management and sales operations, and to manage and deliver advertisements for our products and services more effectively, including on other websites and applications. Such activities allow us to highlight the benefits of using our services, and thereby increase your engagement and overall satisfaction with our services. This includes contextual, behavioral, and interests-based advertising based on your activity, preferences or other data available to us or to our business partners;
  • To contact our customers and prospects with general or personalized service-related messages as well as promotional messages that may be of specific interest to them

We do not sell personal information included in the Mobity Website & Prospect Data.

We and our authorized Service Providers (defined below) maintain, store and process personal information in the United States of America and other locations, as reasonably necessary for the proper performance and delivery of our services, or as may be required by law.

  1. Data Retention

We retain Mobity Website & Prospect Data for as long as it is reasonably necessary for the data uses described in this Privacy Policy; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes (i.e. as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use).

We may share personal information included in the Mobity Website & Prospect Data as follows: 

Legal Compliance: In exceptional circumstances, we may disclose or allow government and law enforcement officials access to your personal information, in response to a subpoena, search warrant or court order (or similar requirement), or in compliance with applicable laws and regulations. Such disclosure or access may occur if we believe in good faith that: (a) we are legally compelled to do so; (b) disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing; or (c) such disclosure is required to protect our legitimate business interests, including the security or integrity of our products and services.

Such service providers include hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, fraud detection and prevention services, web analytics, e-mail distribution and monitoring services, session or activity recording services, remote access services, performance measurement, data optimization and marketing services, social and advertising networks, content providers, e-mail, voicemails, support and customer relation management systems, and our legal, financial and compliance advisors (collectively, “Service Providers“). Service Providers may have access to Mobity Website & Prospect Data depending on each of their specific roles and purposes in facilitating and enhancing our services and may only use it for such limited purposes as specified in our agreements with them. 

Third Party Websites and services: Our Websites and services may include links to third-party websites, and integrations with third-party services. Such websites and third-party services, and any information you process, submit, transmit or otherwise use with such websites and third-party services, are governed by such third-party’s terms and privacy practices and policies, and not by this Privacy Policy. We encourage you to carefully read the terms and privacy policies of such website and third-party services. 

Protecting Rights and Safety: We may share personal information with others if we believe in good faith that this will help protect the rights, property or personal safety of Mobity, any of our users or customers, or any members of the general public. 

Change in Control or Ownership: Should Mobity undergo any change in control or ownership, including by means of merger, acquisition, or purchase of substantially all or part of its assets, personal information may be shared with or transferred to the parties involved in such an event. If we believe that such change in control might materially affect your personal information then stored with us, we will notify you of this event and the choices you may have via e-mail or prominent notice on our services. 

Additional Data Sharing: We may share Mobity Website & Prospect Data in additional manners, pursuant to your explicit approval, or if we are legally obligated to do so, or if we have successfully rendered such data non-personal, non-identifiable and anonymous. We may transfer, share, or otherwise use non-personal and non-identifiable data at our sole discretion and without the need for further approval. 

  1. Cookies and Tracking Technologies

We and our Service Providers use cookies and other technologies for performance, tracking, analytics, and personalization purposes. We may share non-identifiable and aggregated extracts of such information with our partners for our legitimate business purposes. 

Cookies are packets of information sent to your web browser and then sent back by the browser each time it accesses the server that sent the cookie. Some cookies are removed when you close your browser session. These are the “Session Cookies”. Some last for longer periods and are called “Persistent Cookies”. We use both types. 

We use Persistent Cookies to remember your log-in details and make it easier for you to log-in the next time you access our Websites. We may use this type of cookies and Session Cookies for additional purposes, to facilitate the use of the services’ features and tools. 

While we do not change our practices in response to a “Do Not Track” signal in the HTTP header from a browser or mobile application, you can manage your cookies preferences, including whether or not to accept them and how to remove them, through your browser settings. We and our hosting services implement systems, applications, and procedures to secure your personal information, to minimize the risks of theft, damage, loss of information, or unauthorized access or use of information. These measures provide sound industry standard security. 

In situations where we have given you or you have chosen a password to access certain parts of our Websites, you are responsible for keeping this password confidential and for complying with any other security procedures that we notify you of. Please do not share your password with anyone. 

However, although we make efforts to protect your privacy, we cannot guarantee that our Websites or services will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse. We make no warranty whatsoever to you, express or implied, regarding the security of the Website. Any transmission of Personal Information is at your own risk. We assume no liability for any disclosure of data due to, among other things, errors in transmission, unauthorized third-party access, or other acts of third parties, or acts or omissions beyond our reasonable control.

The personnel working for these parties may reside outside your country and/or your Personal Information may be stored by us or by them outside your country. When (if) your Personal Information is transfsrred to and/or stored in another country, we will ensure that it is protected and transferred in a manner consistent with legal requirements.

Updates and Amendments: We may update and amend this Privacy Policy from time to time by posting an amended version on our services. The amended version will be effective as of the date it is published. After such notice period, all amendments shall be deemed accepted by you. 

External Links: While our Websites and services may contain links to other websites or services, we are not responsible for their privacy practices. We encourage you to pay attention when you leave our Websites or the services for the website or application of such third-parties, and to read the privacy policies of each and every website and service you visit. This Privacy Policy applies only to our Websites and services. 

Our services are not designed to attract children under the age of 13: We do not knowingly collect Personal Data from children and do not wish to do so. If we learn that a person under the age of 13 is using our Websites or services, we will attempt to prohibit and block such use and will make our best efforts to promptly delete any personal information stored with us with regard to such child.
